Acceptable Use Policy

This section states the actions forbidden by SpaceCDN and prohibited customer behavior of SpaceCDN's content delivery networks. SpaceCDN has the right to alter these conditions any time by releasing a new edition of this document on SpaceCDN’s web-site.

 

Illegal Use

SpaceCDN's CDN and the rest of its products may be used for lawful purposes only. It is prohibited to store, distribute, or transmit any material in violation of applicable laws. That includes, but not limited to the material protected by trademark, trade secret, copyright and other intellectual property rights exploited without permission of right holder, and material that is improper, defamatory, poses illegal threats, or contradicts export control laws.

 

Adult Content

SpaceCDN allows using of SpaceCDN's services by providers of “adult content”. There is no restriction on the character of “adult content” that may be served by companies, but all the content should be legal under the laws of the European Union, Cyprus, and the United States of America, and “adult content” should comply with all other Terms of Service.

 

Unauthorized or Malicious Hacking

It is strictly prohibited to breach system or network security, terminate or suspend account without notice since it may lead to civil and criminal liability. SpaceCDN will investigate such occasions and bring to responsibility in cases when criminal violation is suspected. Instances of network security or system violation include, but are not limited to: unlawful access or use of data, networks or systems, including attempts to violate, test or scan system or network vulnerability to breach security or authentication tools without system or network's owner authorization. Unlawful examination of data or traffic of any system or network without expressed authorization of the owner of the network and system. Intervention with service of any other customer, host or network including but not limited to mail flooding, intended attempt to overload a system and perform attacks. Falsifying of any TCP-IP packet header and any part of header information in an e-mail or a newsgroup posting.

Sending of one or similar messages to one or more groups of people (also called “SPAM”) is strictly prohibited

 

E-mail

Distribution of unsolicited messages (SPAM), which includes but is not limited to commercial advertising and announcements, is strictly forbidden. A user should not use mail server of another site to send mail without permission of the web-site. Besides, this policy applies to all content and e-mail distributed by a customer or on a user's behalf which has a SpaceCDN account as a mailbox for responses, or uses content hosted or distributed via SpaceCDN facilities, or which shows that SpaceCDN was involved in distribution of such content or e-mail.

Infraction Notifications under the Digital Millennium Copyright Act

To submit a notice of infraction with SpaceCDN, you should connect with us in written form, written communication should have your legal signature and be sent via e-mail (in PDF format), fax or regular mail. Please note that you may be responsible for damages (as well as attorney's fees and expenses), if you misrepresent that an activity of product that does not infract your copyright. If you doubt whether material online infringes your right, we recommend contacting your attorney first.

 

Counter Notifications

The administrator of an affected web-site, or the provider of affected content has right to make a counter notification according to sections 512(g)(2) and (3) of the Digital Millennium Copyright Act. When SpaceCDN received a counter notification, it may reinstate the issued material. To submit a counter notification with SpaceCDN, you should make a written communication with your legal signature and send it via e-mail (in PDF format), fax or regular mail. Please note that you may be responsible for damages (as well as attorney's fees and expenses), if you misrepresent that an activity of product that does not infract your copyright. If you doubt whether material online infringes your right, we recommend contacting your attorney first.

 

To create and submit a request, please make a letter in the following format (includes the numbers of sections):
  • State the copyrighted work that you suppose has been infringed upon (for instance, “The copyrighted piece is the article posted on http://www.legalpage.com/legal_work.html”) or other information to prove that the copyrighted work has been infringed.
  • State the material that infringes the copyrighted work identified in the section 1 above. If you are going to send many URLs in one request, please additionally send an electronic version of the notice
  • Provide enough information for SpaceCDN to contact you (e-mail address is preferable)
  • If possible, provide enough information for SpaceCDN to warn the administrator or owner about infringing other content or web page (e-mail address is preferable).
  • Sign the document.
  • Send it to us in written form to abuse@spacecdn.com.
